The New York State Office of Cannabis Management (OCM) is reminding cannabinoid hemp retailers of the requirements for cannabinoid hemp beverage products sold in New York State.

To comply with New York’s Cannabinoid Hemp Program, a cannabinoid hemp beverage product must:

  • Contain less than 0.3% Delta-9 THC;
  • Contain a 15:1 or higher ratio of CBD to THC. If CBD is not the primary marketed cannabinoid, the sum of cannabinoids excluding THC must have a ratio of at least 15:1 to THC;
  • Contain only one serving per can or package; and
  • Contain no more than 1 milligram of THC per can or package.

Please Note: Cannabinoid hemp beverages containing more than 1 milligram of THC per package are prohibited under New York’s Cannabinoid Hemp Program.

Additionally, any establishment selling cannabinoid hemp products in New York State — including online retailers — must obtain the appropriate license from OCM.

Selling cannabinoid hemp products without the required license or selling illicit cannabis products that do not meet program requirements may result in enforcement action, including seizure of products, significant monetary penalties and padlocking of a storefront.

Licensees and retailers are encouraged to review OCM’s guidance to ensure all cannabinoid hemp products offered for sale comply with New York State requirements.
