The Australian national medicines watchdog, the Therapeutic Goods Administration (TGA), has commenced Federal Court proceedings against Better Leaf Pty Ltd, Better Life Aussie Pty Ltd, and their sole director, Jack Weisberg. [1]
⚖️ The Allegations
The lawsuit follows repeated failures by the entities to pay multiple prior infringement notices issued by the regulator. According to the TGA’s filings, the defendants allegedly committed 44 advertising breaches between November 2022 and May 2025. The core allegations include: [1, 2, 3, 4, 5]
- Unapproved Marketing Mediums: Promoting prescription-only medicinal cannabis via their public website, Facebook and Instagram pages, and physical pamphlets distributed at their dispensary. [1, 2]
- Restricted and Prohibited Claims: Making illegal claims that medicinal cannabis could treat over 100 serious diseases and conditions—including cancer pain, autism spectrum disorder, epilepsy, chronic pain, PTSD, and insomnia—without TGA permission. [1, 2]
- False Government Endorsement: Creating advertisements that falsely implied their products were officially approved or recommended by the TGA. [1]
- Illegal Professional Endorsements: Using prohibited testimonials and endorsements from current or former healthcare practitioners to promote their inventory. [1, 2]
🚫 Why This Violates Australian Law
Under the Therapeutic Goods Act 1989, medicinal cannabis is classified as a prescription-only medicine. In Australia, it is strictly illegal to advertise prescription medicines directly to the public. This framework exists to protect vulnerable consumers from misleading health claims and ensure treatment decisions are guided solely by independent medical professionals. [1, 2, 3]
🏛️ Seeking Penalties
Because the companies allegedly ignored previous warnings and a formal compliance notice, the TGA is now seeking official court declarations and substantial financial penalties against both corporate entities and Mr. Weisberg personally. [1]
TGA’s Official Announcement
TGA sues Better Leaf and Better Life Aussie for alleged unlawful advertising of medicinal cannabis
Published
4 August 2026
The Therapeutic Goods Administration (TGA) has commenced proceedings in the Federal Court of Australia against Better Leaf Pty Ltd (Better Leaf), Better Life Aussie Pty Ltd (Better Life), and their sole director Mr Jack Weisberg for the alleged unlawful advertising of medicinal cannabis in contravention of the Therapeutic Goods Act 1989 (Cth) (the Act).
This escalated action follows repeated warnings from the TGA to the companies and multiple infringement notices issued to Better Leaf and Mr Weisberg for alleged unlawful advertisements, which were not paid.
The TGA alleges that the companies unlawfully advertised medicinal cannabis on its website, social media pages, and physical pamphlets at its dispensary business.
The companies allegedly promoted the use of medicinal cannabis for the treatment of serious diseases, conditions and disorders. Such references are known as restricted representations or prohibited representations and are not allowed to be included in advertising for therapeutic goods unless an approval or permission is given by the TGA.
The advertisements are also alleged to have implied that medicinal cannabis has been approved or recommended on behalf of the TGA and included endorsements from current or former health practitioners.
The TGA also alleges that Mr Weisberg, in his capacity as the business manager or sole director of both companies, is personally liable for the alleged contraventions.
The TGA is seeking declarations and pecuniary penalties against Better Leaf, Better Life and Mr Weisberg.

While this matter is before the Court, the TGA will not be commenting further.
The TGA reminds businesses that they are responsible for understanding and complying with their regulatory obligations under the Act when advertising therapeutic goods in Australia.
If you suspect non-compliance in relation to therapeutic goods, you can report it to the TGA at any time.
