California DCC publishes AB 8 hemp guide for enforcement agencies

The Department of Cannabis Control (DCC) has published "Hemp for enforcement agencies", last reviewed 5 November 2026. It summarises AB 8 (Stats. 2025, ch. 248) for law enforcement. It is guidance, not new law.

  • Banned from unlicensed retail: hemp flower, hemp pre-rolls, inhalable hemp THC products, synthetic cannabinoids, cannabinoid alcoholic drinks and cannabis products made outside the licensed market (BPC 26070.2).
  • Retailer penalties: BPC 22980.6 adds penalties for smoke shops and retailers. The page gives no amounts.
  • Targets: smoke shops, vape stores, unlicensed distributors and online sellers.

What changes in the law we track

One rule changes, for retailers and sellers of hemp concentrates: California's cannabis excise tax. Today it is 15% of retail gross receipts, through 30 June 2029. From 1 January 2028, AB 8 extends it, and its penalties (Rev. & Tax. Code § 34015.3), to illegal hemp and certain hemp concentrates, excluding CBD-isolate-only products. Until then the rule is unchanged.

What this means

Enforcement tools already exist. The DCC can fine a licensee up to $5,000, and an unlicensed person up to $30,000, per violation per day (4 CCR § 17802(c)(3)).

Limits

  • The page does not state the section 22980.6 penalty amounts or the text of section 34015.3.
