Event Pilot Procedures

Following two public hearings earlier in October, the Board reviewed the latest revisions to the Events Pilot Procedure. The Board adopted the Procedure with amendments provoked by public comments received. CCB staff will open the event application process in November. A lottery will be held during the Board’s regular meeting of December 16. The Events Procedure can be found here.

Retail Siting Rule

The Board reviewed the proposed Retail Siting Rule, agreed on changes, and voted to initiate rulemaking proceedings in accordance with the Administrative Procedure Act, 3 V.S.A., ch. 25. As with all proposed rule amendments, the retail siting language will be reviewed at a public hearing which all may attend. Once the Rule is approved for publication with the Secretary of State, the Board will distribute invitations to comment with participation instructions.

Label disclosures of terpene additives

Director of Compliance Mike DiTommaso discussed product safety and labeling issues associated with terpene additives to inhalable cannabis products. Following discussion, the Board affirmed that existing laws and CCB Rules require full and accurate disclosure of all additives. Staff will consider rule amendments to ensure permitted terpene additives are appropriately regulated at the point of manufacture.

Consumer Data Privacy and eCommerce Security Guidance

The Board approved a new guidance document addressing Board policy on consumer data privacy and security requirements for electronic commerce. Broadly, the guidance: (1) clarifies that Rule 2.8.3(d)-(e) require informed consumer consent prior to profile-building or data collection, and (2) reminds establishments that all users are bound by the Agency of Digital Services Information Security Foundations Policy. Licensees were warned not to facilitate evasion of the Inventory Tracking API by inappropriately sharing web login credentials with third parties. The guidance is posted to the CCB website and open for comment until the Board’s November 18 meeting.

Authorization to Initiate Rulemaking

The Board authorized staff to propose needed updates to Rule 2, as well as to produce a first-ever Rule 5, which will govern hearing practice and member removal.

ID cards for principals & controllers

The Board adopted the policy that principals/controllers of licenses must obtain an employee ID card when working at another cannabis establishment. Implementation is deferred until the November meeting so impacted principal/controller cardholders can comment and have time to obtain employee cards. Read the policy document on the CCB website.
