The Oregon Health Authority has formally proposed new medical marijuana regulations that would expand patient eligibility for hospice and palliative care, establish additional requirements for care facilities and revise certain rules governing dispensaries and processing sites.

The proposed changes to Oregon Administrative Rules Chapter 333, Division 8, filed October 29, implement House Bill 4142, known in part as Ryan’s Law, which Governor Tina Kotek signed in April. The regulations follow a September advisory committee meeting and are now moving through the public comment process.

Under the changes, Oregon’s list of qualifying medical marijuana conditions would explicitly include the need for hospice, palliative care, comfort care or other symptom management, including comprehensive pain management. The expansion is scheduled to become operative January 1, 2027.

The proposed regulations also establish procedures for organizations and residential facilities designated as additional caregivers under the Oregon Medical Marijuana Program.

Covered facilities would be required to submit an attestation confirming that they have established the written policies and completed the training requirements mandated by the new law. Those policies must address the procurement, storage, administration and disposal of marijuana and medical cannabinoid products.

Employees providing direct care would receive training covering marijuana pharmacology, dosing methods, administration techniques, contraindications and potential interactions with other medications.

Certain facilities, including hospitals, hospital-affiliated clinics, home health agencies and specified hospice programs providing services in home care settings, are exempt from those requirements.

Beyond hospice access, the regulations would update how Oregon evaluates petitions to add qualifying conditions to its medical marijuana program.
