Virginia CCA page details retail licence tiers and a 1 July 2027 sales start

The Cannabis Control Authority has updated its retail marijuana market page with licence types and a licensing process outline. Applications have not opened, and the page's regulatory timeline still shows draft rules for September 2026.

The Virginia Cannabis Control Authority (CCA) has updated its Retail Marijuana Market page. It describes the licence types and how licensing will work under the 2026 legislation. The page's timeline runs from draft regulations in September 2026 to regulations effective in January 2027. Conversion applications for pharmaceutical processors and industrial hemp processors or growers are due to open by 1 February 2027. The CCA's deadline to issue certain initial licences is 1 May 2027, and retail sales begin on 1 July 2027.

The page covers cultivation (five tiers, 5,000 to 35,000 sq ft, Tiers III to V indoor only), processing, retail store, microbusiness, transporter, delivery operator, testing and dual-use licences. It says applications "have not yet opened". If qualified applicants outnumber licences, a lottery run by Smartplay International will decide. A separate lottery for impact licensees comes first where licences are reserved for them. Unsuccessful applications are retained for one year without a new fee.

What this means

Our analysis: the page leaves roughly four months between conversion applications opening (1 February 2027) and the date medical permits need dual-use verification (1 June 2027).

Medical operators

Under Va. Code § 4.1-1602(A), from 1 June 2027 no previously issued medical permit stays valid without dual-use verification. The conversion fee amount has not been published. Pharmaceutical processors and dispensing facilities could map their conversion steps against the final regulations.

Applicants

Preliminary approval gives 18 months, with one extension of up to six months, so up to 24 months to supply location details. The local body then has 30 days to object, and the CCA decides within 90 days. The Board may issue no more than 350 retail licences (§ 4.1-606(C)). The number of licences per type has not been published. Applicants could prepare for the impact-licensee lottery under § 4.1-1000(E).

Retailers

The page gives 800 mg THC in edibles per transaction. Section 4.1-1406 caps edibles at 100 mg per package. Our analysis: 800 ÷ 100 gives eight maximum-strength packages.
