Niles voters cap city cannabis shops at five; Niles Township keeps its retail ban
Unofficial results show City of Niles voters approved limits of five retailers and four microbusinesses, while Niles Township voters rejected, 52% to 48%, a measure to allow up to four shops. The township's rules have changed three times since 2022, and each result stands only until the next petition and vote.

Voters in the City of Niles, Michigan, approved the "City of Niles Limitation on Marihuana Establishments Ordinance" on Tuesday. Niles Township voters kept their retail ban. This highlights the challenge for any business planning to set up in a town that has changed its mind 3 times in 4 years.
- City: 61% for, 39% against. Retail stores are capped at five and microbusinesses at four. Microbusinesses cannot convert to full retail. WNDU, citing The Herald-Palladium, says the city had an overall limit of eight since 2018.
- Township: 52% rejected a measure to allow up to four retail shops. Voters rejected retail in 2022, approved it in 2024, reinstated a ban last year and reaffirmed it now.
What this means
Our analysis: in Niles, an operator's right to open depends on local votes, not on the state licence, and the township has changed its answer three times in four years.
- Michigan sets no cap on any type of state licence (MCL 333.27958(3)(a)). A municipality may prohibit or limit establishments (MCL 333.27956(1)).
- Where a cap leaves qualified applicants without a licence, the municipality must choose by a competitive process (MCL 333.27959(4)). City applicants therefore face a fixed number of places.
- Residents can force a vote. A petition needs signatures from more than 5% of the votes cast for governor at the last gubernatorial election, and goes to voters at the next regular election (MCL 333.27956). This is a reading: it explains the township's swings and is why capital there carries repeat-vote risk.
Limits
- The ordinance and measure texts, the effective date, the number of existing city licences and any grandfathering are not published in the article.
- We have not found a Michigan rule on how soon a ban can be put to voters again.
- Results are unofficial.
